1. PREAMBLE AND SCOPE

These Terms and Conditions of Sale (the "Terms") govern the offer and sale of products via the website https://skalecosmetics.com/ (the "Site").

By placing an order on the Site, you unconditionally accept these Terms.

2. PRODUCTS

The essential characteristics of the products are described on the Site. While we strive for accuracy, photographs and descriptions are for illustrative purposes and may differ slightly from the actual product. SKALE LABS reserves the right to modify the assortment of products at any time.

3. PRICING

Prices are displayed in the currency of your region at the time of purchase. Depending on your country, prices may be shown in Euros (EUR), Pound Sterling (GBP), US Dollar (USD), Canadian Dollar (CAD), Australian Dollar (AUD), New Zealand Dollar (NZD), Swiss Franc (CHF), Czech Koruna (CZK), Danish Krone (DKK), Hungarian Forint (HUF), Icelandic Króna (ISK), Japanese Yen (JPY), Norwegian Krone (NOK), Polish Zloty (PLN), Romanian Leu (RON), Serbian Dinar (RSD), Singapore Dollar (SGD), South Korean Won (KRW), or Swedish Krona (SEK). The applicable currency is automatically determined based on your location.

For customers outside the European Union (Export): Prices are quoted excluding French VAT (Tax Free).

4. CUSTOMS DUTIES AND TAXES (IMPORTANT)

If you order products for delivery outside of the European Union, your order may be subject to import duties and taxes which are applied when the delivery reaches that destination.

  • You are the importer of record.

  • You serve as the declarant regarding customs.

  • SKALE LABS has no control over these charges.

Please note that you are responsible for the payment of any such import duties, taxes, and handling fees. Failure to pay these fees may result in the destruction or return of the package; in such cases, SKALE LABS will not refund the shipping costs or the return fees.

5. ORDERS AND PAYMENT

The contract is formed when you confirm your order and pay the full price. Payment is due immediately upon ordering. We accept payments via the following methods: Credit card (Visa, Mastercard, American Express), Apple Pay, PayPal, Shop Pay, Klarna, Bancontact, BLIK, EPS, Cartes Bancaires, and MobilePay. All transactions are secured and encrypted through the Payment Card Industry Data Security Standard (PCI-DSS).. Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you. Your data is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS).

6. SHIPPING AND DELIVERY

Products are delivered to the address indicated during the ordering process. Delivery times provided on the Site are estimates only. SKALE LABS cannot be held responsible for delays caused by customs clearance processes or carrier delays. Risk of loss and title for items purchased from this Site pass to you upon delivery of the items to the carrier (Ex Works / FCA) OR upon delivery to you, depending on the applicable consumer laws of your country.

7. RIGHT OF WITHDRAWAL (RETURNS)

As a French company, we apply the European standard. You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period will expire after 14 days from the day on which you acquire physical possession of the goods.

  • Return Costs: You will have to bear the direct cost of returning the goods (shipping back to France).

  • Refund: We will reimburse all payments received from you (excluding shipping costs if the return is partial or if you chose a non-standard delivery method).

Exceptions: The right of withdrawal does not apply to:

  • Goods made to the consumer's specifications or clearly personalized.

  • Sealed goods which were unsealed after delivery and are not suitable for return due to health protection or hygiene reasons.

8. LIMITATION OF LIABILITY

SKALE LABS shall not be liable for any indirect damages arising from the purchase of the products. Our total liability for any claim arising out of or relating to these Terms or the products shall not exceed the purchase price paid by you.

9. GOVERNING LAW AND JURISDICTION

These Terms and your use of the Site are governed by and construed in accordance with the laws of France. Any dispute relating to the interpretation, validity, or execution of these Terms shall be subject to the exclusive jurisdiction of the courts of Paris, France, notwithstanding multiple defendants or third-party claims.
